SUPREME COURT TOO NOT SPARED

by Mohanavadivelan S , MAY 15, 2019

#ME TOO like allegation has touched the Apex court as well.I am talking about the complaint by a former employee of the Supreme court of India against the Chief Justice of India. The appalling nature of such allegations are the delay in coming forward to expose the erred and the after thought in exposing them which makes the allegations absolutely unfounding. The said recent allegation against the CJI and the subsequent developments made the public differ in their opinion and the indifferent opinion galore unbound among the public of all walks of life as everything looks pale to the jaundiced eye.People in the know of things know that there are independant procedures within judicial system to protect the independance of the judiciary while others look awkwardly about this. In house procedures and Indira jaising vs Supreme Court of India case apart, the refusal of the complainant to appear and depose before the in house committee, having complained is the bottom line for the collective decision of the members of the said in house committee to decide infavour the CJI of the Apex court. The complainant's failure to call a spade a spade in this case, whoever it may be she is speaking against and in whichever the forum fixed the fate of this case and resulted in a clean chit to be given by the same to the CJI brushing aside the charges leveled by the complainant against the CJI.

Having chosen a forum, the complainant ought to have followed the procedures inherent in the said forum and in the particular proceedings, though she has other ways and means to legally fight the issue.Decision of the complainant in this case not to appear and depose before in house committee forgetting that it takes two to make a quarrel is bad and it's consequences are abound, legally. The act of the complainant leveling some allegation against the CJI and failing to substantiate the same with her deposition before the in house committee for one or the other reason shows that she is malice personified and the said act is an abuse of the judicial system.Throw dirt enough and some will stick is what she would have thought of and acted in a way detrimental to herself and to the judiciary as a whole.Trust deficit cannot be attributed to the system or the proceeding followed by the system but to be attributed to the persons making the complaint as the instant one against the CJI without any basis and so failing in their duty to stand by their very own allegations. She should be thanking the Lords for not taking her to the task and sparing inspite of the abuse committed by her either on her own or on someone else's behest.Let this be the wake up call to everyone concerned.
